The Groupchat · Last updated: [DATE OF PUBLICATION]
These terms are the agreement between you and us when you join The Groupchat (the "Community"). They cover your membership, payments, cancelling, what happens to the things you post and what we can and can't promise. We wrote them in plain English on purpose. Please read them before you join. If something is unclear, email us at [PRIVACY EMAIL].
The Community is run by Captivate Agency, owned by Isa Vrolijk, registered with the Dutch Chamber of Commerce (KvK) under number [KVK NUMBER], located at [BUSINESS ADDRESS], the Netherlands. VAT number: [VAT NUMBER]. When these terms say "we", "us" or "Isa", they mean Captivate Agency.
The Community is invite-only. You can join only with a personal invitation from us. An invitation is not a right to join, and we may decline or withdraw an invitation before you sign up.
Your invitation and your account are personal. Don't share your login or forward your invite link to someone else.
You must be at least 16 years old to join. If you are under 18, you need permission from a parent or guardian to pay for a membership.
Please give us correct details when you sign up and keep your email address up to date, because that's where your login codes go.
You're responsible for what happens in your account. If you think someone else has access to it, tell us straight away.
3. Plans and payments
There are two memberships. Both are billed through our payment provider, Stripe.
Membership

Yearly
What you get
Regular
[REGULAR MONTHLY PRICE]
[REGULAR YEARLY PRICE]
Full access to the Community: group chat, private chats, feed, notes, profiles, points and leaderboard, AI matching, classroom and calendar.
VIP
[VIP MONTHLY PRICE]
[VIP YEARLY PRICE]
Everything in Regular, plus [VIP EXTRAS] and the golden crown on your profile.
All prices are in euros and include Dutch VAT, unless we clearly say otherwise.
You pay in advance for each period (a month or a year). Your subscription renews automatically at the end of each period until you cancel.
You can pay with the methods Stripe offers at checkout, such as iDEAL or card. You get an invoice by email and can find all invoices in the Stripe customer portal.
If a payment fails, Stripe will try again. If it still fails, we may pause your access until the payment goes through.
We may change our prices. If your price goes up, we'll tell you at least 30 days before it applies to you, and you can cancel before the new price starts. A price change never affects a period you already paid for.
Isa can also give VIP status by hand, for example as a thank-you or reward. VIP status given this way is a gift, has no cash value and can be ended at any time.
[TRIAL TERMS, IF ANY: for example "New members get a free trial of X days. If you don't cancel before it ends, your paid membership starts automatically."]
4. Your 14-day right of withdrawal
If you join as a consumer in the EU, you have the right to change your mind within 14 days after you sign up, without giving a reason. This is called the right of withdrawal.
If you want access straight away
Most people want to start using the Community right after they pay. Because that means we start delivering our service during your 14 days, the law asks for your explicit consent first. At checkout you tick a box to confirm that:
you ask us to give you access immediately, before the 14 days are over; and
you understand that if you withdraw, you pay for the days you already had access, and that you lose your right of withdrawal once the service has been fully delivered or for digital content (such as course lessons) that has already been made available to you.
So in practice: if you withdraw within 14 days, we refund what you paid minus a fair amount for the days you were a member. If you don't tick the box, your access starts after the 14 days are over.
How to withdraw
Email [PRIVACY EMAIL] within 14 days with a clear message that you want to withdraw. You can use this text if you like:
"To Captivate Agency, [BUSINESS ADDRESS], [PRIVACY EMAIL]: I hereby withdraw from my contract for a The Groupchat membership. Ordered on: [date]. Name: [your name]. Email address of my account: [email]. Date: [today's date]."
We'll confirm we received it and refund you within 14 days, using the same payment method you used to pay.
5. Cancelling
You can cancel any time in the Stripe customer portal. You'll find the link under your account settings in the Community. Cancelling takes a few clicks and you don't need to explain why.
When you cancel, your membership stays active until the end of the period you already paid for. After that it stops and you won't be charged again.
Outside the 14-day withdrawal period, we don't refund the rest of a period you already started, unless the law says we must or we agree to it.
Yearly plans: after your first year, you can cancel a renewed yearly plan at any time with one month's notice, and we'll refund the full months you haven't used.
Cancelling your membership is not the same as deleting your account. If you also want your account and data deleted, see our Privacy Policy or email us.
6. Your content
Everything you post in the Community, such as messages, posts, notes, comments, photos, videos and files, stays yours. We don't claim ownership of it.
To make the Community work, you give us a licence to use your content. That licence is:
limited: we only use it to store, show and share your content inside the Community, with the members who can see the space you posted it in, and to make backups;
free and non-exclusive: we don't pay you for it, and you can still use your content anywhere else you like;
ending when you delete it: it stops when you delete the content or your account, except for copies in backups that are overwritten within 30 days, and content you chose to leave up anonymously.
We will never use your content outside the Community, for example in our marketing or on social media, without asking you first.
Only post things you have the right to share. You're responsible for your content and promise it doesn't break the law or anyone else's rights, such as copyright or privacy.
The Community itself, including its design, courses, lessons, templates and other materials we create, belongs to Captivate Agency. You can use it for yourself while you're a member, but you can't copy, resell or share it outside the Community.
7. Points, leaderboard and surprise bonuses
You earn points for taking part, for example by posting, commenting, liking, chatting and joining calls. Points show up on the leaderboard, and Isa sometimes hands out surprise bonuses. It's meant to be fun and to reward people who show up.
Points, bonuses and leaderboard positions have no cash value. You can't exchange, sell or transfer them, and they don't give you a right to any prize unless we clearly say so for a specific challenge.
Isa decides how points work and may change the rules, the number of points per action, the bonuses and the rewards at any time. She can also correct points that were given by mistake.
Gaming the system isn't allowed. Think point farming, spam posts or comments just for points, fake accounts, liking in bulk or sitting in calls without taking part. If we see it, we may remove the points, reset your score, or suspend or remove your account.
When your membership ends, your points and leaderboard position end too.
8. AI matching, horoscope and Human Design are for fun
"Find my matches" uses AI to suggest members you might click with, based on your profile. Your horoscope and Human Design summary are calculated from the birth details you choose to add. These features are there to spark connections and conversations.
They are not professional, medical, psychological, financial, legal or business advice. Please don't base important decisions on them.
AI suggestions can be wrong or a bit off. A match is a suggestion, not a recommendation or a guarantee about another person.
You decide who you connect with and what you share. Use your own judgement when you meet or work with other members.
9. Private chats
1:1 chats are end-to-end encrypted in your browser. That means we can't read them, and neither can our hosting providers. Two things to know:
Because we can't read private chats, we can't moderate them. If someone bothers you in a private chat, report it to us (see our Community Guidelines) and share what's needed, for example a screenshot sent only to us.
If you lose access to the device or browser that holds your encryption keys, older private messages may not be recoverable. We can't restore them for you.
Group chats, the feed and other shared spaces are not end-to-end encrypted, so we can see and moderate them.
10. Using the Community
Everyone has to follow our Community Guidelines. On top of that, you agree not to:
break the law, or post content that is illegal, hateful, threatening, discriminating or sexually explicit;
harass, intimidate or impersonate anyone;
share other members' personal information, private messages, screenshots of private chats or recordings of calls without their permission;
send spam or sell to members in private messages without their consent;
scrape, copy or download the Community or members' data, or use bots or automated tools without our permission;
try to hack, overload or get around the security of the platform, or access accounts or areas that aren't yours.
We may remove content that breaks these terms or the guidelines. We don't check everything before it's posted, but we act when we see a problem or someone reports it.
11. Suspension and termination
If you break these terms or the guidelines, we may give you a warning, remove content, pause your account or end your membership. How we respond depends on how serious it is. For serious cases, such as harassment, threats or sharing private chats, we can remove you straight away without a warning.
We'll tell you why, unless the law doesn't allow it or it would put someone else at risk. If you think we got it wrong, email us and we'll look at it again.
If we remove you because you broke the rules, you won't get a refund for the period you already paid for. If we end your membership for any other reason, we refund the unused part.
We may stop the Community altogether. If we do, we'll tell you at least 30 days in advance and refund any period you paid for but can't use.
Sometimes the Community may be briefly unavailable for maintenance or because of technical problems. We do our best to keep it running smoothly but can't promise it will always be online.
12. Liability
We put a lot of care into the Community, but we have to set some limits. Dutch law applies to these limits, and nothing here takes away rights you have as a consumer under the law.
We are not responsible for what other members post, say or do, inside or outside the Community, including in private chats, calls and deals you make with each other.
We are not responsible for services of third parties that we link to or use, such as Stripe, Zoom or Instagram, beyond what the law requires.
We are not liable for indirect damage, such as lost profit, missed opportunities or lost data.
If we are liable, our liability is limited to the amount you paid us for your membership in the 12 months before the damage happened.
These limits don't apply if the damage was caused by our intent or gross negligence, or where the law doesn't allow us to limit liability.
13. Governing law and disputes
These terms are governed by Dutch law. If you live in another EU country, you still keep the protection that the consumer law of your own country gives you.
If you have a complaint, email us first at [PRIVACY EMAIL]. We reply within 14 days and do our best to solve it together. If we can't, the dispute goes to the competent court in the Netherlands, or to the court of the place where you live if the law gives you that right.
14. Changes and contact
We may update these terms when the Community changes or the law requires it. We'll announce important changes in the Community and by email at least 30 days before they apply. If you don't agree with a change, you can cancel before it starts. The date at the top shows the latest version.
